AudioMasterizer is a project created by Art of Dev (artofdev.space). “Art of Dev” is a creator brand and project name, not a separately registered company.
AudioMasterizer is a desktop software application for macOS that processes audio locally on the user’s computer. It provides mastering profiles, audio processing tools, before/after comparison and the ability to export mastered audio files. AudioMasterizer is a software product and is not a human mastering service, a marketplace, a financial product, a medical product, a crypto product, or a service that guarantees revenue or any artistic, technical or commercial result.
You must be legally able to enter into this agreement and, where applicable, be of the age of majority in your jurisdiction. You are responsible for providing accurate purchase information, for keeping your license information confidential, and for ensuring that your equipment meets the system requirements. You are responsible for your own audio files, backups, and for holding all rights necessary to process the audio you use with the software.
Subject to your payment and to these Terms, the Seller grants you a personal, limited, non-exclusive, non-transferable and revocable license to install and use AudioMasterizer for your own use, in accordance with the activation rules communicated at purchase or in the app. This is a license to use the software; it is not a sale of the software itself, of its source code, or of any intellectual property rights in it.
Except to the extent expressly permitted by applicable mandatory law, you may not:
AudioMasterizer is activated using a license key delivered to you by email after purchase. The software may verify your license occasionally to confirm that it is valid and to detect fraud or abuse. Verification may transmit limited technical information necessary for that purpose, as described in our Privacy Policy. Activation may be limited to a defined number of devices, as indicated at purchase or in the app.
After purchase, you can download and install the macOS application. You are responsible for verifying that your system meets the requirements shown on the website and download page before installing. The Seller is not responsible for incompatibilities resulting from unsupported operating systems, hardware or third-party software.
The Seller may, but is not obliged to, provide updates. Some updates may be included with your license; major upgrades, optional add-ons, PDF reports or premium modules may be offered as separate paid products. The Seller does not promise unlimited free updates. Any paid upgrade or add-on will be clearly identified before purchase.
Prices are shown on the Pricing page and at checkout. Unless stated otherwise, AudioMasterizer is sold for a one-time payment. Applicable taxes (such as VAT/sales tax) may be calculated and added at checkout depending on your location. You are responsible for any charges imposed by your bank or card issuer.
Payments are processed by PayPal as the payment provider. AudioMasterizer (João dos Santos de Almeida, trading as AudioMasterizer, Switzerland) is the seller of record for your purchase; PayPal securely processes the payment on our behalf. AudioMasterizer is responsible for delivering the license, for issuing any receipt or invoice, and for accounting for any applicable taxes. By paying through PayPal, you also agree to PayPal’s applicable user agreement. AudioMasterizer does not receive or store your full payment card details or PayPal login credentials. Billing and payment questions can be directed to AudioMasterizer support.
Refunds are governed by our Refund Policy, which forms part of these Terms. As AudioMasterizer is a digital product delivered electronically, specific conditions apply. Refund requests can be sent to contact@artofdev.space. A refund may result in deactivation of the associated license. Nothing in this section limits mandatory consumer rights that may apply to you.
You agree to use AudioMasterizer lawfully and not to use it to infringe intellectual property or other rights, to process content you are not authorised to process, or to attempt to disrupt, abuse or gain unauthorised access to the software, license system or related services.
All rights, title and interest in and to AudioMasterizer — including the software, source code, mastering engine, user interface, design, the AudioMasterizer name and brand, this website, the license system, the customer base, the sales and payment system, and the commercial operation — remain the exclusive property of João dos Santos de Almeida, trading as AudioMasterizer, and/or its licensors. No rights are granted to you except the limited license expressly set out in these Terms.
AudioMasterizer may include selected audio reference material, mastering references or related materials prepared by external contributors and used under a separate authorization. Such external contributions do not affect the ownership of the software, brand, website, interface, license system, customer base, payment system or commercial operation, which remain with João dos Santos de Almeida, trading as AudioMasterizer.
AudioMasterizer includes selected audio reference material and mastering references prepared by sound engineer Jean David Boiston under a separate authorization. This credit does not imply partnership, co-ownership, employment, agency, joint venture, or revenue-sharing rights unless expressly agreed in writing. See our Credits page.
You retain all rights to the audio files and content you process with AudioMasterizer. The Seller claims no ownership of your audio files. You are solely responsible for ensuring you hold the necessary rights and permissions for any audio you process.
AudioMasterizer processes audio locally on your device. Your audio files are not uploaded to AudioMasterizer servers, except for any future feature that is explicitly described and that you actively choose to use. You are responsible for maintaining your own backups. The Seller is not responsible for any loss, corruption or damage to your audio files.
AudioMasterizer is provided as a tool. The Seller does not warrant or guarantee any particular artistic result, technical quality, loudness or compliance target, streaming performance, commercial success, revenue or fitness for a particular creative purpose. Results depend on your source material, settings and judgement.
Support is provided by email at contact@artofdev.space for installation, activation, billing and general questions, on a reasonable-effort basis. See the Contact page for details.
The Seller may modify, improve, suspend or discontinue features of AudioMasterizer, or the product as a whole, at any time, to the extent permitted by law. Reasonable efforts will be made not to materially reduce the core functionality available to existing license holders without cause.
The Seller may implement reasonable technical measures to protect the software, the license system and customers against fraud, abuse, unauthorised use and security threats, including license verification and limited logging as described in the Privacy Policy.
The Seller may suspend or deactivate a license in the event of fraud, abusive sharing, a chargeback, a breach of these Terms, or an attempt to circumvent activation or license verification. Where reasonable and lawful, the Seller will try to notify you. You may stop using the software at any time; ending use does not by itself entitle you to a refund except as provided in the Refund Policy or by mandatory law.
Initiating a chargeback without first contacting support to resolve an issue may be treated as a breach of these Terms and may result in deactivation of the license. Fraudulent purchases, payment fraud and abuse are prohibited and may be reported to PayPal and the relevant authorities.
To the maximum extent permitted by applicable law, AudioMasterizer is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. This section does not exclude or limit any warranty or right that cannot be excluded or limited under applicable mandatory law (including consumer law).
To the maximum extent permitted by applicable law, the Seller shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, goodwill or audio material, arising out of or relating to the software. To the extent liability cannot be fully excluded, the Seller’s total aggregate liability is limited to the amount you actually paid for the license giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud.
To the extent permitted by law, you agree to indemnify and hold harmless the Seller against claims, damages and reasonable costs arising from your unlawful use of the software, your breach of these Terms, or your processing of audio for which you did not hold the necessary rights.
If you purchase as a consumer, you may benefit from mandatory consumer protection rights under the law of your country of residence. Nothing in these Terms removes or limits any such mandatory right. Where mandatory consumer law conflicts with these Terms, that law prevails to the extent of the conflict.
These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The courts at the Seller’s place of business in Switzerland have jurisdiction, subject to any mandatory jurisdiction or applicable law that grants a consumer the right to bring proceedings in, or benefit from the protection of, the courts of their country of residence. This clause does not deprive a consumer of mandatory protections of their home jurisdiction.
The Seller may update these Terms from time to time. The current version is published on this page with its “last updated” date. Material changes will apply to purchases made after they are published. Your continued use of the software after changes take effect constitutes acceptance of the updated Terms, to the extent permitted by law.
