Terms of Service

1. Acceptance of Terms

By accessing and using AudioMasterizer ("Service"), you accept and agree to be bound by the terms and provision of this agreement.

2. Use License

Permission is granted to temporarily use the Service for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose without proper licensing
• Attempt to decompile or reverse engineer any software contained on the Service
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. Account Terms

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms.

You are responsible for safeguarding the password and for all activities that occur under your account.

4. Service Availability

We strive to provide uninterrupted service, but we do not guarantee that the Service will always be available, uninterrupted, or error-free.

5. Audio Content

You retain all rights to your audio files. We do not claim ownership of any audio content you upload. By uploading content, you grant us permission to process and store your files for the purpose of providing the Service.

We automatically delete processed files after 30 days. You are responsible for downloading and backing up your mastered tracks.

6. Prohibited Uses

You may not use the Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To upload or transmit viruses or any other type of malicious code

7. Subscription and Billing

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis.

Billing cycles are set on a monthly basis. At the end of each billing cycle, your subscription will automatically renew unless you cancel it.

8. Refunds

We offer a 14-day satisfaction guarantee. If you are not satisfied with our service within 14 days of your first payment, contact us for a full refund.

9. Limitations of Liability

In no event shall AudioMasterizer or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit) arising out of the use or inability to use the Service.

10. Modifications to Service

AudioMasterizer reserves the right to modify or discontinue, temporarily or permanently, the Service with or without notice.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.
